Gerhard Riebel

finally acquitted in West Germany in 1963–1964; date of death unknown 1914–?

Gerhard Riebel served as commander of the 3rd Company of Police Battalion 322, later the 9th Company of Police Regiment Centre. The profile reconstructs the person’s function in Białystok, Dulag 185, Mogilev and occupied Belarus through documented office, decisions, supervision or operational conduct. It does not assign every crime committed by an institution or region to one individual.

Confirmed findings

  • He commanded the 3rd Company of Police Battalion 322, which after reorganisation operated as the 9th Company of Police Regiment Centre.
  • From 9 to 16 July 1941, his company guarded the Dulag 185 prisoner-of-war transit camp near Białystok. The unit's report recorded guards killing 71 Jews and two Soviet prisoners of war on the pretext of attempted escape; the document does not establish that Riebel personally fired the shots.
  • In a report he signed on the operation at Mogilev on 2–3 October 1941, he stated that an operation involving several formations had detained 2,208 people and that the 9th Company had killed 65 people on the spot. Further records assigned that company a role in shooting 545 of those detained.
  • The Freiburg Regional Court acquitted him on 12 July 1963 in a trial concerning participation in mass executions. The Federal Court of Justice rejected the prosecution's appeal on 14 January 1964, making the acquittal final.

Place in the chain of responsibility

Riebel's case makes it possible to compare a company commander's own reports with the outcome of a later trial. The reports document command responsibility and the recording of killings committed by the company, but they do not substitute for proof that he personally shot anyone; the final acquittal must be presented alongside the documents, neither suppressed nor interpreted as meaning that the events described in them did not occur.

The circle records authority, function and agency. Several profiles may describe different parts of the same persecution chain, so profile-level totals must not be added together.

Postwar accountability

He stood trial before the Freiburg Regional Court with other members of Police Battalion 322 on charges of participation in mass executions. The court acquitted him on 12 July 1963. The Federal Court of Justice rejected the prosecution's appeal on 14 January 1964, so the proceeding did not end in a conviction.

Limits of the evidence

The company reports describe the results of collective operations and do not permit the automatic conclusion that Riebel personally killed the people listed. It is equally important to distinguish his documented signature and command function from the scope of evidence deemed sufficient in the trial, which ended in a final acquittal. His date of death has not been confirmed.
